3. Beat Licensing and Usage #

3.1. General #

All beats on Moodtape Beats are protected by copyright law. When you purchase a beat, you are not buying ownership of the original composition; rather, you are purchasing a License to use the instrumental under specific terms.

3.2. License Types #

We offer various license types (e.g., Standard, Premium, Unlimited, Exclusive). Each license type comes with specific terms regarding:

• Usage: What you can do with the beat (e.g., record vocals, create a song).
• Distribution Limits: The maximum number of copies (e.g., streams, downloads) of your song that can be distributed.
• Commercial Use: Whether and how you can generate revenue from your song.
• Broadcasting Rights: Use in radio, TV, film, or other media.
• Stems/Tracked-Out Files: Availability of individual instrument tracks.
• Ownership: Whether you receive exclusive ownership of the instrumental.

It is your responsibility to carefully read and understand the terms of each license before making a purchase. The specific terms of your chosen license will be provided at the time of purchase and will supersede any general descriptions.

3.3. Royalty-Free vs. Exclusive #

• Non-Exclusive Licenses (Leases): For most leases (Standard, Premium, Unlimited), you will not owe us ongoing royalties (a percentage of your song’s revenue) to Moodtape Beats, but we retain ownership of the beat and may continue to license it to other artists.
• Exclusive Licenses: If you purchase an Exclusive License, you gain full ownership of the instrumental. We will no longer be able to license that specific beat to other artists. Specific terms regarding publishing rights may apply and will be detailed in the exclusive agreement.

3.4. Prohibited Uses #

Regardless of the license type, you are expressly prohibited from:

• Reselling, redistributing, or sub-licensing the Beat itself (unless explicitly agreed upon in an Exclusive License contract).
• Registering the Beat (in its original instrumental form) with any PRO (Performance Rights Organization), sound exchange, or content ID system.
• Using the Beat in a manner that is defamatory, illegal, or infringes on any third-party rights.
• Making the Beat available for free download or public distribution without permission.

4. Purchasing and Delivery #

4.1. Order Process #

To purchase a beat, select your desired license type and proceed to checkout. All prices are listed in the currency specified on the Site.

4.2. Payment #

We accept payments via Stripe and PayPal. By submitting an order, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order.

4.3. Delivery #

Upon successful payment, you will receive an immediate email with a download link to your purchased beat(s) and your specific License Agreement. Please ensure your email address is correct. Check your spam/junk folder if you do not receive the email within a few minutes. If you experience any issues, please contact us promptly.

5. Refunds and Cancellations #

Due to the digital nature of our products, all sales are generally final and non-refundable. We encourage you to listen to beat previews carefully before making a purchase.

However, if there is a technical error with the download, a corrupted file, or a proven error on our part, please contact us within [e.g., 7 days] of your purchase. We will investigate the issue and may offer a replacement, credit, or refund at our sole discretion.
